Your plant shop checklist, item by item
Q: What licenses and permits might I need to start a plant shop?
A: Let us walk through what your plant shop may need, piece by piece, so nothing surprises you on opening day.
1. Business license: A business license for a plant seller MAY ask what plants you grow or resell, whether they are houseplants or outdoor stock, and if you sell at fairs and online.
2. Home occupation permit: A home occupation permit MAY apply if plants are grown or kept in a yard or garage, usually with limits on shoppers, deliveries, water runoff and signage.
3. Sales tax permit: A sales tax permit MAY be needed because plants sold at retail are generally taxable, and a resale certificate may cover wholesale buying.
4. Plant health certification: Certain plants may need inspection or certification before sale, especially fruit trees and shipped stock.
5. Seller's market permit: Selling at fairs and markets may require a vendor permit for each event.
6. Nursery stock record: A short list of plants you carry may be requested so inspectors know what to look for.
7. Landlord clearance statement: A signed note allowing plants and shoppers at home may be asked for.
8. Company papers: A DBA, an LLC or a tax ID number MAY make sense for your plant shop, and we prepare all of these documents on this site, so everything can be ordered in one place.
One service fee covers more than one license. If you order a business license and it turns out you also need another one, for example a home occupation permit, we obtain both for the service fee of the business license. Annual tax and application fees charged by the govt are not part of our service fee: we find the applications and fill them out for you.
Why it is worth the paperwork
Houseplants are a booming trend and every sale usually leads to a repeat buyer wanting just one more pot for the window.
Opening day, imagined
Ignatius carried his first crate of ferns to the stall under the Green Thumb Gazette banner and called it his leafy start.
What can go wrong
A shopper trips over a tray of pots and breaks an ankle, so without an LLC your home could be reached to cover the claim.
Codes and counts
Business code (NAICS): 444220 (Nursery, Garden Center, and Farm Supply Stores), 444240 under the 2022 update. This page lists 8 paperwork items for a plant shop, and each one is marked as something you MAY need, since we confirm which apply.
Tip: Track losses and unsold stock so you can price in the inevitable wilted fern.
Plants are the only pets that do not mind if you forget their name.
Ready when you are: start your order and we will find out what applies to your plant shop, fill out the applications and keep the paperwork moving. |
